Councillors to rule on 'rogue' development

SUNSHINE Coast councillors will determine the fate of Aria's Mooloolaba Breeze development at a public general meeting next Thursday with planning head Christian Dickson saying he has received strong calls from industry and the community for the council to stand its ground.

The development was built outside its development approval with all units sold of the unapproved plan.

A report from council officers would be tabled as a late agenda item at the October 13 meeting and would include advice from an external architect commissioned by the council.

Cr Dickson said council officers had compiled the report into an application by the developer for a permissible change of use, free of any direction.

The developer is seeking relaxations to its original approval to accommodate the non-compliant alterations to balconies and layouts.

It would be a public document and may be released as early as today.

Cr Dickson said although the matter could have been determined by delegated authority he had sought and obtained majority support to have it determined by councillors.

"It's early days and I'm yet to see information but I've had contact from industry and residents who are calling it a matter of principle and I agree," he said.

"We issue approvals and the planning scheme is in place so everyone can play by common and equitable rules.

"As a council we shouldn't accept this regardless of who it is. I want people to follow the rules."

Cr Dickson said he had contacted Aria to explain why the report was coming before councillors.

The development on the corner of Meta Street and the Esplanade with a third frontage to First Avenue was granted a series of concessions to the planning scheme based on the anticipated design outcomes.

In an earlier report in response to Aria's attempts to retrospectively win approval for the completed building, said the original approval had been at the upper limits of the planning officer's authority to provide those concessions.
